§1. GENERAL PROVISIONS

1. The organiser of the LACAVA Loyalty Programme (hereinafter referred to as the "Program") is LACAVA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, at al. Bednarska 7, 05-830, KRS: 0000838337, NIP: PL5252821302, REGON: 385948433, tel.: +48 22 726 77 00, e-mail: biuro@lacava.pl (hereinafter referred to as the "Organiser").
2. The program is implemented in the territory of the Republic of Poland.
3. Each participant is required to read these Terms and Conditions before joining the Program. Participation in the Program constitutes acceptance of the rules contained in these Terms and Conditions.
4. The Program is not a game of chance, a raffle, a mutual bet or a promotional lottery, the outcome of which depends on chance within the meaning of Article 2 of the Gambling Act of 19 November 2009.
5. All capitalized terms have the meaning given to them in the Regulations of the lacava.pl online store, unless these Regulations provide otherwise.

§2. PARTICIPATION IN THE PROGRAM

1. Conditions for joining the Program:
• having an active account in the lacava.pl store
• acceptance of the Program Regulations
• placing your first order in the online store lacava.pl
2. The program is intended for natural persons with full legal capacity and persons with limited legal capacity with the consent of their legal representatives.
3. Membership in the Program is voluntary and free of charge.
4. An account in the Program is assigned to a specific user and cannot be transferred to other people.
5. The participant undertakes to update his/her personal data provided during registration.
6. The Program may not be used for commercial or profit-making purposes. Entities conducting activities competitive to the Organizer are not permitted to participate in the Program.

§3. PARTICIPATION LEVELS AND RULES FOR COLLECTING POINTS

1. There are three levels of participation in the Program: a) "Enthusiast" Level (0-4999 points):
• 1 PLN spent = 1 point
• birthday gift: 200 points
• welcome bonus: 100 points
• following on FB, IG: 100 points
• early access to discounts

b) "Connoisseur" level (5000-14999 points):

• 1 PLN spent = 2 points
• birthday gift: 300 points
• following on FB, IG: 100 points
• early access to discounts
• the ability to exchange points for free products and gifts
• special products for program members

c) "Ambassador" level (15000+ points):

• 1 PLN spent = 3 points
• birthday gift: 500 points
• following on FB, IG: 100 points
• early access to discounts
• the ability to exchange points for free products and gifts
• special products for program members
• early access to limited editions
1. Additional ways to collect points:
• 100 points for following on Instagram
• 100 points for following on Facebook
• 100 points for leaving a review
• 100 points for creating a newsletter account
• Up to 500 points on your birthday (depending on your membership level)
2. Points are earned automatically after completing an activity or purchase.
3. In the event of a return of purchased products, the points accrued for the order will be deducted from the participant's account.
4. You can check your points balance after logging in to your account on the lacava.pl website in the "Loyalty Program" tab.

§4. RULES FOR EXCHANGING POINTS FOR BENEFITS

1. Points can be exchanged for:
• Discounts on coffee at lacava.pl
• Free products (for Connoisseur and Ambassador levels)
• Special prizes and gifts
2. Points to discount conversion rate:
• 100 points = free shipping
• 300 points = 5% discount
• 500 points = 10% discount
• 1000 points = 15% discount
3. Rules for using discounts:
• Only one discount code can be used per order
• Discounts cannot be combined with other promotions, unless the terms and conditions of a given promotion state otherwise.

4. Procedure for exchanging points for discounts:
a) Logging in to your account at lacava.pl
b) Go to the "Loyalty Program" tab
c) Selecting a discount corresponding to the number of points you have
d) Using a discount code when placing an order

5. Discounts granted:
• are disposable
• cannot be exchanged for cash
• cannot be traded
• they have a specific validity period specified when they were granted

§5. VALIDITY OF POINTS AND LOSS OF STATUS

1. Points are valid for 12 months from your last order.
2. Lack of purchasing activity for a period of 12 months results in:
• cancellation of accumulated points
• back to base level (Enthusiast)
3. The Organizer may inform the participant electronically about the approaching expiration date of points.

§6. COMPLAINTS

1. Complaints regarding the operation of the Program can be submitted:
• by e-mail to the following address: biuro@lacava.pl
• in writing to the address of the Organizer's registered office
2. The complaint should include:
• contact details of the reporting person
• description of the problem
• expected solution
3. Complaints are considered within 14 days from the date of receipt.

§7. PERSONAL DATA PROTECTION

1. The administrator of participants’ personal data is LACAVA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
2. Personal data will be processed solely for the purpose of:
• implementation of the Program
• calculating and exchanging points
• communication related to the Program
• handling complaints
3. The legal basis for data processing is:
• participant's consent (Article 6, paragraph 1, letter a of the GDPR)
• performance of the contract (Article 6, paragraph 1, letter b of the GDPR)
• legitimate interest of the controller (Article 6(1)(f) of the GDPR)
4. Participants have the right to:
• access to your data
• data rectification
• deletion of data
• processing restrictions
• data transfer
• filing an objection
• withdrawal of consent to processing
5. Detailed information regarding the processing of personal data can be found in the Privacy Policy available at lacava.pl.

§8. TERMINATION OF PARTICIPATION IN THE PROGRAM

1. The Participant may resign from the Program at any time by:
• deleting an account in the lacava.pl store
• sending the resignation to biuro@lacava.pl
2. The Organizer may exclude a participant from the Program in the event of:
• violation of the provisions of the Regulations
• providing false data
• using the Program contrary to its intended purpose
3. The participant will be informed electronically about exclusion from the Program.

§9. FINAL PROVISIONS

1. The organizer reserves the right to:
• end the Program at any time
• changes to the Regulations for important reasons
2. Participants will be informed about any changes to the Regulations 14 days in advance via:
• e-mail message
• announcement on the website lacava.pl
3. Changes to the Regulations will not violate the acquired rights of participants.
4. In matters not regulated by these Regulations, the provisions of Polish law shall apply.
5. The Regulations enter into force on January 20, 2025.
